Website Terms of Use
These terms cover the use of our websites, tacitlabs.co.uk, including the pages for each of our products, and refundmyrail.co.uk. They are not the terms for any of our apps: each app has its own, published with the app.
1. Who we are
1.1 Tacit Labs Ltd runs these websites. We are registered in England and Wales, company number 17110976, at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ.
1.2 You can reach us at developer@tacitlabs.co.uk, or at privacy@tacitlabs.co.uk about personal data.
2. These terms
2.1 By using tacitlabs.co.uk, including our product pages, or refundmyrail.co.uk, you accept these terms. If you do not accept them, please do not use the sites.
2.2 How we handle personal data is a separate matter, covered by our Privacy Policy and our Cookie Notice.
2.3 We may change these terms. The date at the top shows the most recent change, and the version you accept is the one live when you use the sites. Changes apply from the date they are posted and do not affect your earlier use.
3. Using our websites
3.1 You are welcome to read, link to and share our pages.
3.2 Please do not:
- use the sites for anything unlawful;
- try to reach any part of them, or any system connected to them, that is not meant to be public;
- interfere with how they work, whether by introducing anything malicious or by placing an unreasonable load on them;
- harvest data from them by automated means without our permission; or
- misuse our signup forms, including by submitting an address that is not yours.
3.3 We may withdraw access to the sites, or to a signup form, from anyone who does any of that.
4. Our content
4.1 We own, or are licensed to use, everything on these sites: the text, the design, the images, the code and the name and logo of Tacit Labs and of each of our products. These are protected by copyright and trade mark law.
4.2 You may quote from and link to our pages, with attribution. You may not copy a substantial part of a site, reuse our content commercially, or use our name or logos to suggest we endorse something, without our written permission.
4.3 We expressly reserve our rights for the purposes of text and data mining. You may not use our content to train or develop machine learning models without our written permission.
4.4 Some of what we publish is open source and carries its own licence. Where it does, that licence governs what you may do with it and these terms do not restrict it.
5. Other people's sites and services
5.1 Our pages link to other websites, and some pages display live information supplied by other companies. We do not control those sites or services, we are not responsible for their content, and we are not responsible for what they do with information your browser sends them by contacting them.
5.2 Separately from that, some measurement and advertising tools load on our pages only if you agree to them. Those are ours rather than other people's, and our Cookie Notice sets out each one, what it collects and how to change your answer.
6. Information on our websites
6.1 We take care to keep our pages accurate and up to date, but we do not promise that they are. Much of what we publish is about products still in development, and plans, features, prices and launch dates can change or be dropped.
6.2 Nothing on our websites is advice you should rely on, and nothing on them is an offer to sell anything. Where a page describes a product, the terms for that product govern it, not this page.
6.3 The delay calculator on refundmyrail.co.uk is an estimate produced from figures you type in. It is not a statement of what any train operator owes you, and it does not replace their claims process.
7. Availability
7.1 We do not promise that our websites will always be available or uninterrupted. We may suspend, withdraw or change any part of them, or any product page, without notice.
8. Our responsibility to you
8.1 We do not exclude or limit our responsibility to you where it would be unlawful to do so. That includes responsibility for death or personal injury caused by our negligence, and for fraud.
8.2 We provide our websites for your general use. We are not responsible for any loss that was not foreseeable at the time you used them, or for any loss caused by an event outside our reasonable control.
8.3 If you use our websites for any business purpose, we have no responsibility to you for loss of profit, loss of business, business interruption or loss of business opportunity.
8.4 Nothing in these terms affects your rights as a consumer, which you always keep. If you live in the European Union or the European Economic Area, that includes the consumer protections of the country where you live.
9. Waitlists and newsletters
9.1 Joining a waitlist reserves nothing and guarantees nothing. It means we will email you about that product as it approaches launch. A product may launch late, launch differently, or never launch at all.
9.2 A waitlist place is personal to you and cannot be transferred or sold.
9.3 You can leave any of our lists at any time, using the removal link in the most recent email we have sent you. Our Privacy Policy explains what we hold and for how long.
10. General
10.1 If any part of these terms turns out to be unenforceable, the rest continues to apply.
10.2 If we do not insist that you do something these terms require, that does not prevent us insisting on it later.
10.3 These terms are between you and us. Nobody else can enforce them.
11. Which law applies
11.1 These terms are governed by the law of England and Wales, and disputes can be brought in the courts of England and Wales.
11.2 If you live in Scotland you may also bring proceedings in Scotland, and if you live in Northern Ireland you may also bring them there.
11.3 If you live in the European Union or the European Economic Area, this does not take away the protection of the consumer law that applies where you live, and you may bring proceedings there.
