1. About us

1.1 — Sip is published by Tacit Labs Ltd, a company registered in England and Wales under company number 17110976, with registered office at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ. You can contact us at privacy@tacitlabs.co.uk.

1.2 — In these Terms, "we", "us" and "our" mean Tacit Labs Ltd, and "you" means the person using Sip.

2. Eligibility

2.1 — Sip is intended for users aged 18 and over, but anyone aged 13 or over may use it. By using Sip you confirm that you are at least 13 years old. If you are under 18, please review these Terms with a parent or guardian.

2.2 — Sip is not intended for, and is not directed at, children under 13. If you believe a child under 13 has used Sip, please contact us at privacy@tacitlabs.co.uk and we will help confirm that any data we hold about that use has been deleted.

2.3 — You confirm that you are not located in, and are not a national or resident of, any country subject to UK or EU sanctions that prohibit the supply of software.

3. Your licence to use Sip

3.1 — Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Sip on Android devices you own or control, for your own personal, non-commercial use.

4.1 — Sip is a personal hydration and caffeine tracking tool. It is not a medical device, does not constitute medical advice, and is not a substitute for professional medical or clinical advice, diagnosis, or treatment.

4.2 — Any guidance Sip provides — including daily water-goal recommendations, caffeine-timing suggestions, and sleep clearance threshold indicators — is generated from general population reference values and the personal profile information you choose to enter. Daily fluid goals are derived from a body-weight-based formula (Yamada et al. 2022, Science), with activity adjustments (Belval et al. 2019, Nutrients), an elderly-age adjustment from age 65 (Volkert et al. 2022, ESPEN), and European Food Safety Authority (EFSA) adequate-intake values applied as a sex-specific minimum floor. This guidance is informational only. It does not account for individual medical conditions, medications, clinical history, climate, or physiological factors beyond the inputs you provide.

4.3 — Pharmacokinetic estimates are model outputs, not measurements. The values Sip displays in connection with caffeine — including estimated caffeine levels in milligrams (computed as onboard and plasma model values), the absorption peak indicator ("at peak"), "half-life ticking", and the sleep clearance status indicator (shown as "caffeine clear" when caffeine is estimated to be below the sleep-safe threshold) — are outputs of a general-population pharmacokinetic curve based on published reference values. They are not measurements of your blood concentrations and are not clinically validated for any individual. They must not be used to manage a medical condition, to decide whether to take or avoid caffeine for medical reasons, or as a substitute for clinical testing.

4.4 — Do not use Sip as the basis for medical or clinical decisions. If you have questions or concerns about your health, hydration, caffeine sensitivity, sleep, pregnancy, medication interactions, or related matters, seek advice from a qualified healthcare professional.

4.5 — To the extent permitted by law, Tacit Labs Ltd accepts no liability for any health outcome arising from reliance on information, recommendations, or estimates produced by Sip.

5. Free tier and advertising

5.1 — Sip is available free of charge. The free tier is supported by advertising served through Google AdMob. By using the free tier you acknowledge that advertisements may appear in the app.

5.2 — In the UK and European Economic Area, advertising is shown in line with the consent choices you make in the Sip consent form on first launch. You can review or change those choices at any time via Settings → Manage Consent.

6. Sip Pro subscription

6.1 — What it includes. Sip Pro is a paid subscription that removes advertising and unlocks premium features. We may add or change Pro features from time to time, but we will not remove a core benefit without reasonable advance notice.

6.2 — Pricing and billing. Current pricing is shown in the Google Play Store before purchase and is charged by Google in your local currency. We may update prices with reasonable notice.

6.3 — Free trials. Where a free trial is offered, the trial period is shown in the Google Play Store before you subscribe. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the then-current price.

6.4 — Auto-renewal and cancellation. Sip Pro renews automatically at the end of each billing period unless cancelled. You must cancel at least 24 hours before the end of the current period to avoid being charged for the next. To cancel: Google Play Store → Profile → Payments & subscriptions → Subscriptions → Sip.

6.5 — 14-day cancellation right (UK/EEA consumers). If you are a consumer in the UK or EEA, you have a statutory right to cancel a subscription within 14 days of purchase. When you confirm a Sip Pro purchase, the Google Play purchase screen will ask you to expressly consent to the immediate supply of Sip Pro and to acknowledge that you will lose your 14-day right to cancel once Sip Pro has been fully supplied. If you do not give that consent, please do not complete the purchase. This does not affect any other statutory rights you have.

6.6 — Refunds and seller of record. Sip Pro subscriptions are sold by Google Play, not by Tacit Labs. Google is the seller of record for billing, tax and refund purposes. Refunds are handled by Google Play under Google Play's refund policy. If you believe you are entitled to a refund under consumer protection law, contact us at privacy@tacitlabs.co.uk and we will assist where we can.

6.7 — Cosmetic trials. We may offer limited-time free trials of individual cosmetic packs. Each pack may only be trialled once per device or Google Play account. Trial periods are shown in-app at the time the trial starts. We may withdraw or modify cosmetic trial offers at any time.

7. Your data

7.1 — Most data you enter into Sip — your hydration logs, profile, caffeine entries, and settings — is stored locally on your device and is not accessible to us.

7.2 — The Privacy Policy applicable to you (the UK Privacy Policy for UK residents, or the Rest of World Privacy Policy for everyone else) explains in full what data is processed, what stays on your device, what (if anything) leaves your device, and your rights over your personal data. Please read it carefully.

7.3 — You retain ownership of all personal data you enter into Sip. We do not claim any rights over it.

9. Intellectual property

9.1 — Sip, including its code, artwork, mascot character, branding, and name, is owned by or licensed to Tacit Labs Ltd and is protected by intellectual property law. Nothing in these Terms transfers any intellectual property rights to you beyond the limited licence in section 3.

9.2 — If you believe content in Sip infringes your intellectual property rights, contact us at privacy@tacitlabs.co.uk with details of the rights, the alleged infringement, and your contact information.

9.3 — Sip includes open-source software components. Their licences are available in-app at Settings → Open Source Licences.

10.1 — Sip integrates with the following third-party services. Your use of them is also subject to their own terms.

11. Disclaimer

11.1 — Sip is provided "as is" and "as available". Except as required by law (including the statutory rights described in clause 11.2), we do not guarantee that Sip will meet your requirements, be uninterrupted, secure, or error-free, or that results obtained through Sip will be accurate.

11.2 — Nothing in these Terms excludes or limits any statutory rights you have as a consumer that cannot be excluded by contract — including, in the UK, your rights under the Consumer Rights Act 2015 in relation to digital content that is faulty, not as described, or not fit for purpose.

12. Our liability

12.1 — To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive loss or damage arising from your use of, or inability to use, Sip — including loss of data, loss of revenue, or loss of goodwill.

12.2 — Subject to clause 12.3, our total aggregate liability to you for all claims arising from or in connection with your use of Sip is limited as follows:

(a) if you have paid us for Sip Pro in the 12 months preceding the claim, to the amount you paid us in that period; or

(b) if you have not paid us anything, to £50.

12.3 — Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law.

13. Changes to Sip and to these Terms

13.1 — We may update these Terms from time to time. If a change is material — for example, a change to data handling, pricing, dispute resolution, or the removal of a core feature, but not limited to those — we will give at least 14 days' notice by an in-app message or notification before it takes effect. The "Last updated" date below will reflect the most recent version.

13.2 — Your continued use of Sip after a change takes effect means you accept the updated Terms. If you do not accept them, please stop using Sip and uninstall it.

13.3 — We may also update, add, or withdraw features of Sip at any time. We will give reasonable advance notice of any significant changes to core Sip Pro benefits.

14. Suspension and termination

14.1 — You may stop using Sip and uninstall it at any time.

14.2 — We may suspend or withdraw Sip, or your access to it, if you breach these Terms, if we are required to do so by law, or if we decide to discontinue Sip. Where possible we will give you reasonable notice before withdrawing the app.

15. Force majeure

We are not liable for any failure or delay in performing our obligations under these Terms where the failure or delay is caused by an event beyond our reasonable control, including infrastructure outages, denial-of-service attacks, acts of government, or natural events.

16. Governing law and disputes

16.1 — These Terms are governed by the laws of England and Wales.

16.2 — Any dispute that cannot be resolved informally is subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in Scotland, Northern Ireland, or Wales, you may also bring proceedings in the courts of that jurisdiction.

16.3 — If you are a consumer resident in an EEA country, you may also bring proceedings in the courts of that country, in line with your local consumer protection rights.

16.4 — Before starting formal proceedings, please contact us at privacy@tacitlabs.co.uk so we can try to resolve the issue informally.
